If your OB was sued for malpractice would you continue to go to him?

well, not only sued but found guilty and the plaintiff awarded a substantial amount of money.

I read an article in our local paper probably a year ago where my doc was found liable and had to pay like a million or something dollars.  I stored the info in my back pocket and thought I could look it up again if I needed to.  I have googled it to death and cannot find the story.  I've checked with the state licensing board and there are no blemishes on his record.

fast forward to last week and I have a phone convo with one of DS1's friend's moms who had a baby about 9 months ago.  She's pregnant again and I knew my doc delivered her first baby so I say are you going to Dr. P still?  Her response knocked the air out of me . . ."oh no, he left xyz in me and they didn't discover it until 9 days later I was in so much pain and started to pass it."

Holy crap.  She's suing him - well, trying to negotiate a settlement without suing.

She goes on to tell me her SIL used him and he was great with her.  He was great with me.  He performed a bladder surgery on my MIL 4 weeks ago (I didn't even know she was going to him until I went to visit her in the hospital after surgery and saw his name on her paperwork).

I want to have my tubes tied this summer.   I really liked him but now I'm really questioning having him perform any procedure on me!

Hard one.  We are such a litigious society that docs get sued all the time.  If there are multiple first hand accouns of concerns, probably not.  If there was ever any question about his or her state during a procudure, probably not.  If i heard my doc got sued in the paper, I would probably assume it was just another law suit, particularly in OB-GYN (don't they have the highest malpractice rate, hence why so many are leaving the field?).  I would have to say if my experience is good, and they are completely solid with the state board, I would probably stay.  That is just me.

YES!!  That is the absolute truth..

I tend to agree with Jenn;  if they're record is good with the state board and I had good experience with them, I'd stay

Mistakes do happen, and people do sue pretty easily these days.

Leaving stuff in someone during surgery is a pretty serious mistake. Also, with the past lawsuit, that doen't seem very good.


I think you'll just have to go with your gut on this one. It's a hard choice. Do you really like him? Or just use him 'cause you always have? Or just 'cause he's close?

I know that with my current OB, I'll be switching docs after I have the baby. I think he's a good Dr, I really like him personally, but I can't put up with the problems I've had with his staff. I trust him to do my c/s, but I am going to refuse to put up with the office staff and nurses anymore. I loved his old nurses, so kept going to him despite the yucky office staff after I had Andrew. Now they are gone, and I am not going to have anymore babies, so I just need to find someone Ilike for a yearly pap.

Agreed with everyone. I have a friend who sues doctors (a plaintiff's lawyer), my firm defends doctors frequently, and I have a friend who is an OB who was sued. I can see all the sides. My Plaintiff's lawyer friend has a "list" in her head of doctors who are bad. I think sometimes people want to blame someone when really, its just bad luck or unfortunate circumstances. And my OB friend pays out the wazoo for malpractice insurance, and the case in which she got sued was just one of those medical circumstances that happens, and cannot be anticipated and so, could not be prevented. But, eventually, the insurance company settles. Doesnt mean that she did anything wrong, jsut that ultimately it would have been too expensive and time consuming to defend further.

Anyway.Trust your gut. Dont be afraid to ask questions and see what answer you get.
